Subject: Amendment to Rule 16(3) of AIS (DCRB) Rules for intensive review of All India Service Officers: Regarding.

I am directed to refer to the above subject and to say that it is proposed to amend Rule 16(3) of the All India Services (Death-Cum-Retirement Benefits) Rules, 1958 as follows:-

Proposed Rule 16(3)
The Central Government may in consultation with the State Government concerned and after giving a member of the Service at least three months previous notice in writing or three months pay and allowances in lieu of such notice require that member to retire in public interest from service on the date on which such member completes thirty years of qualifying service or attains fifty years of age or on any date thereafter to be specified in the notice. The Central Government may in consultation with the State Government concerned and after giving a member of the Service at least three months previous notice in writing or three months pay and allowances in lieu of such notice require that member to retire in public interest from service on the date on which such member completes fifteen years or twenty five years of qualifying service or attains fifty years of age or on any date thereafter to be specified in the notice.

2. It is clarified that in the above proposition of the rule, the officers who will be retired prematurely shall be entitled for pensionary benefits in terms of the relevant provisions of AIS (DCRB) Rules, 1058.

3. It is requested that the comments of the State Government as required under Section 3 of the All India Services Act, 1951 to the proposed amendment in Rule 16 ibid may kindly be conveyed to this Department within two weeks of issue of this letter, If no reply is received by then, it will be presumed that the State Government has agreed to the aforesaid amendment.
