SC upholds linking Aadhaar to PAN and ITR-filing

NEW DELHI, JUNE 09, 2017: GIVING a mega boost to the confidence of the Union Government which has been backing Aadhaar as a mandatory piece of identity, the Apex Court today validated the provisions of the Income Tax Act making Aadhaar mandatory for issuance of PAN and filing of ITR.
The Suprme Court Bench granted a partial stay till the Constitution Bench decides the privacy issue linked to it. In other words, if a taxpayer has no Aadhaar, it is not mandatory for him but if one has Aadhaar allotted to him, it is necessary for the taxpayer to disclose the same for its PAN and the ITR.
Netizens may recall that the Section 139AA of the I-T Act made it mandatory for PAN and ITR from July 1, 2017.
The Bench of Justice A K Sikri and Justice Ashok Bhushan upheld the powers of the Parliament to legislate on this issue.
