CBDT takes serious note of laxity in clearing Compounding cases & launching prosecution

NEW DELHI, MAR 08, 2017: THE CBDT has taken a serious note of the lax approach towards filing of prosecution and clearing of pendency of compounding applications.
The CBDT Chairman has written to the field formations that a list of cases was forwarded for taking action u/s 276CC in the very beginning of the F.Y. Besides, a list of potential cases of prosecution for TDS default was uploaded on TDS portal in the month of October, 2016. Prosecution proceedings can be successfully initiated in several cases of entry operators including those concerning bogus LTCG claims, cases rejected by Settlement Commission, added he.
He has also pointed out that a large number of compounding applications have been pending disposal for long.
The Chairman has also stated that prosecution and compounding are important areas against tax evaders and non-compliant assessees and cannot be allowed to be ignored. In this background, the Chairman has asked senior officers to expedite filing of prosecution complaints and disposal of compounding applications.
