Master Circular on SCN, Adjudication & Recovery - CBEC all set to redeem its promise

NEW DELHI, JANUARY 20, 2017: TIOL Netizens may recall that before the closing of the Rajaswa Sangam the CBEC Chairman had announced that the CBEC would scrap all the hoary Circulars and issue a Master Circular containing critical issues such as SCN, Adjudication and Recovery. Though, with the GST round the corner, such a Circular may not serve the cause of revenue for too long but the CBEC is keen to redeem its promise.
In this regard, the CBEC intends to issue an extensive Circular on Show Cause Notice, Adjudication and Recovery by consolidating 85 circulars of Central Excise.
The oldest Circular referred is more than three decades old.
The said master circular intends to compile relevant legal and statutory provisions on the subject by including all relevant Circulars issued in the past and by rescinding Circulars which are no longer relevant.
The master circular covers a total of thirty (30) subjects and is divided into four parts. Part I deals with Show Cause Notice related issues, Part II deals with issues related to Adjudication proceedings, Part III deals with closure of proceedings and recovery of duty and Part IV deals with miscellaneous issues.
It is further informed that once the Master Circular comes into vogue, 82 of these Circulars would be rescinded and the three referred Circulars, issued in the past three years, would alone survive.
Feedback on the Master Circular is sought from the Trade and also from the officers of the department, the last date being 15th February 2017.
