GOVERNMENT had declared today as holiday on account of Id-ul-Fitr, but it has been brought to the notice of the Government that in Delhi Id-ul-Fitr will be celebrated on 7th July, 2016. Accordingly, it has been decided to shift the Id-ul-Fitr holiday to 7th July, 2016 in place of 6th July, 2016 as notified earlier, for all Central Government administrative offices at Delhi / New Delhi.

And that is why this DDT is before you.

Anti Dumping Duty on Purified Terephthalic Acid - No duty for period between lapsing of provisional and imposition of final ADD

THE  Government had imposed provisional anti dumping duty on  Purified Terephthalic Acid including its variants Medium Quality Terephthalic acid  & Qualified Terephthalic Acid falling under tariff item 2917 36 00 of the First Schedule to the Customs Tariff Act originating in, or exported from the People's Republic of China, Iran, Indonesia, Malaysia and Taiwan, by Notification No. 60/2015-Cus (ADD), dated 10.12.2015.

This expired on 9th June 2016. But the Designated Authority found that:

(i) the subject goods have been exported to India from subject countries below its normal value, resulting in dumping;

(ii) the domestic industry has suffered material injury due to dumping of the subject goods from the subject countries;

(iii) material injury has been caused by the dumped imports of subject goods from the subject countries,

and has recommended the imposition of definitive anti-dumping duty on imports of the subject goods originating in, or exported from the subject countries;

And so the Government has re-imposed the duty with effect from 5th July 2016. But what about the duty for the period from 10th June to 5th July?

The Government has clarified that the said anti-dumping duty shall not be levied for the period commencing from the date of the lapse of the provisional anti-dumping duty, that is, the 10th June, 2016 upto the preceding day of the publication of this notification in the Official Gazette.

Anti-dumping duty on Polypropylene - Notfn. 7/2016-Cus(ADD) amended

VIDE notification 119/2010-Cus., dated November 19th 2010, Anti-dumping duty on "Polypropylene" originating in, or exported from, Singapore was imposed for a period of five years beginning 30th July, 2009. Obviously, the five year period ended in July 2014 and everyone was caught napping.

But the designated authority had initiated a review a day before the notification was to expire and he had requested for extension of the anti-dumping duty for a further period of one year. And it takes time for the giant wheels of the government machinery to move.

So, by Notification No. 38/2014-Customs (ADD), dated the 13th August, 2014,   they extended the life of the Notification till 29th July, 2015 - this was done 15 days after the death of the original notification.

This notification again died on 29.7.2015. But the Designated Authority has come to the conclusion that injury to the domestic industry is likely to continue in the event of cessation of anti dumping duty on imports of these goods from the non-cooperative producers or exporters from Singapore and has recommended imposition of the anti-dumping duty on the goods, originating in or exported from the Singapore.

So, the Government again imposed Anti Dumping Duty on this product with effect from 8.3.2016 for another five years. The notification is 7/2016-Cus(ADD).

What about anti dumping duty on this product from 30.7.2015 to 7.3.2016? No one knows.

Interestingly, when ADD was imposed on Polypropylene by notification 119/2010-Cus, Polypropylene meant (i.e., homo-polymers of propylene and copolymers of propylene and ethylene excluding the expanded Polypropylene beads).

However, when it was re-imposed by notification 7/2016-Cus(ADD), Polypropylene meant (i.e. homopolymers of propylene and copolymers of propylene and ethylene).

Kindly note that the portion shown in red above is missing.

Therefore, the Central Government has now amended this notification - there is a substitution made and it says that - Polypropylene (i.e. homo-polymers of propylene and copolymers of propylene and ethylene, excluding expanded Polypropylene beads and ter-polymer)

Interestingly, the portion shown in red makes a reappearance along with 'ter-polymer'.

Notification making is certainly an excruciating process.

PM Modi on GST

IN our history, I do not think there has been any law which has been debated as extensively and as long and at as many levels as the GST Bill. The states and especially the consuming states now understand the benefits of GST. Most of the states have clearly understood that GST will benefit the poor through buoyancy of revenue, enabling better services to them. The poorest states will benefit even more.

The people in these states have also now understood this. So much so, the obstruction of GST is now not a Lok Sabha issue but has become a Gram Sabha issue! The public in states like UP, Bihar and West Bengal will be the biggest beneficiaries. Therefore, I do not think any political party will try to commit suicide by opposing GST. As for the deadline for GST, as an optimist, I believe more in lifelines than in deadlines.  

Cycling his way to North Block - Finance Ministry Gets Two Ministers of State

THE Finance Ministry has got two Ministers of State instead of one - Jayant Sinha has moved into Civil Aviation.

Legal Corner IconMr. Santosh Kumar Gangwar and Mr. Arjun Ram Meghwal are the new Ministers of State.

Mr. Meghwal cycled to the Rashtrapati Bhavan yesterday to take oath as a Minister.

He has been cycling to Parliament quite often. This MP from Bikaner is an example of success through hard work. He got married when he was studying in the 8th standard. He went on to earn BA, LL.B, MA and MBA. He started life as a weaver and weaved his way through a small job in the Telephones Department, selection in the Rajasthan Administrative Service and finally into the IAS. He was elected to the Lok Sabha in 2009 and 2014 and yesterday became the MoS in Finance.

When he was Collector of Churu District, the people of the District published a book on his works, "EK COLLECTOR AISA BHI".

Increase in Tariff Value of Silver

GOVERNMENT has increased the tariff value of silver. The Tariff values of other items remain unchanged.
